You will sometimes see a listing marked “Bumi lot”. It changes who may buy the property and who you can sell it to later. This guide explains the term, and the separate idea of Malay reserve land.

Bumi lots

In a housing development, the State Authority can allocate a share of units to Bumiputera interest. Foreign interests are not allowed to acquire property allocated to Bumiputera interest in a development. Source: Malaysian Bar, Circular No 012/2024 (Ministry of Economy guideline). The share of units, and whether and when unsold units can be released to other buyers, is decided by each state. If a seller says a unit has been released, ask for the written approval.

Malay reserve land

Malay reserve land is land declared and gazetted under a state’s Malay reservation law. It cannot be transferred, charged or leased to a non-Malay, and dealings against those laws are void. Kelantan allows some dealings with the Ruler in Council’s approval. Sabah and Sarawak have no such enactment. Source: Malaysian Bar, Circular No 369/2023: Overview of law on Malay reservation lands. Property built on Malay reserved land is also closed to foreign interests. Source: Circular No 012/2024. Last checked 26 Sep 2026.

How to check

  1. Ask the agent or developer in writing whether the unit is a Bumi lot and whether the land is Malay reserve land.
  2. Ask your lawyer to search the title before you pay a booking fee.
  3. Get any release approval in writing, for the specific unit.

A seller who is vague about this is a reason to slow down. See scam awareness.
